NUIVI Terms of Use

1. Who we are and what NUIVI is

NUIVI (nuivi.com.br) is an AI music creation service operated by Roque Tráfego Pago ("NUIVI", "we"). Payments and subscriptions are processed by Hotmart, which appears as the seller at checkout and on the charge.

How it works: you describe the song you want to hear in one sentence, or paste your own lyrics. NUIVI writes the lyrics with an artificial intelligence language model and produces the audio with artificial intelligence infrastructure providers. Each creation returns 2 versions of the same idea, with the same lyrics and different arrangements, for you to choose from.

These Terms apply to the website, the Studio (creation area), the My songs library, the My account page and the support channels. They do not replace the Hotmart terms, which govern payment, and they do not apply to third-party websites NUIVI links to.

2. Acceptance and who may use NUIVI

• Age: NUIVI is for people aged 18 or over. Anyone under 18 may only use it with the authorization and supervision of a legal guardian, who is responsible for the use and for the subscription.
• Personal account: the account is yours and non-transferable. You are responsible for everything done with it, so keep your password safe and tell support if you suspect unauthorized access.
• One subscription, one account: the plan quota belongs to your account. Sharing the password, reselling access or splitting one subscription among several people is not allowed.
• Lawful use: you agree to use NUIVI only for lawful purposes and in accordance with these Terms.

3. Account and access

Sign-in uses e-mail and password through an authentication service (Clerk). If the sign-in screen offers login with a third-party account (for example, Google), you may use it; in that case, the provider gives us your name and e-mail.

A Hotmart purchase is identified only by the e-mail entered at checkout. When the payment is approved: if you do not have an account yet, you receive an invitation at that e-mail to create your password; if you already have an account with the same e-mail, the month’s quota is added to your balance the next time you open the Studio. So use the same e-mail on NUIVI as on the purchase. If you bought with a different e-mail, contact support.

You can change your e-mail and password in your account settings. To delete your account, ask through the support e-mail (see the Privacy Policy).

4. Subscription and plans

NUIVI is sold as a monthly subscription with no minimum term. The three plans have the same features and differ in the number of creations per month:

The prices above are in Brazilian reais (BRL) and apply to the site in English and in Portuguese. On the Spanish site (/es), the same plans are sold in US dollars, through separate Hotmart offers. The current prices, quotas and conditions are always the ones shown on the pricing page and at the Hotmart checkout when you subscribe. We may change prices and plans for new subscriptions; your ongoing subscription keeps the conditions of the offer you subscribed to, under Hotmart’s rules.

5. How the quota works

• 1 creation = 1 unique song = 2 versions: each creation uses 1 unit of the quota and returns two versions of the same idea. This applies to the Simple, Advanced, Bulk (up to 20 requests per batch) and Cover modes.
• Renewal: the quota is released after each payment is confirmed and renewed with each approved charge. It does not accumulate: whatever is left over from one month is discarded at renewal. Songs already created stay in your account.
• Writing assistants: the Write with AI and Improve style buttons do not use the quota, but they require an active subscription with balance.
• Failed generation: if a creation does not come out, the credit is automatically returned to your balance.
• End of the paid period: when the paid period ends without a new approved charge (unpaid renewal, cancellation, refund or chargeback), creating new songs is blocked until a new payment. Your account and library remain accessible. There may be a grace period for renewals that are still being processed.
• Technical limits: up to 10 creations processing at the same time per account; in Cover, files up to 25 MB and 8 minutes, with an hourly upload limit. These limits keep the service stable and may be adjusted.

6. Payment, cancellation and refunds

Billing is monthly and recurring, handled by Hotmart with the payment methods available at checkout. NUIVI does not receive or store card details: they stay with Hotmart.

You can cancel whenever you want, with no penalty, through Hotmart (the buyer area or the channels indicated in the purchase e-mail). When you cancel, you keep access to creation until the end of the period already paid, and there is no further charge.

Refund requests follow Hotmart’s rules, which provide a 7-day guarantee after purchase. When a payment is refunded, disputed or cancelled, access to creation ends immediately and the quota for that period is removed.

If you want to cancel or request a refund and cannot do it through Hotmart, write to support and we will guide you.

7. What you can and cannot create

You are responsible for everything you submit to NUIVI: descriptions, lyrics, titles, styles and, in Cover mode, the audio file. By uploading audio, you declare that you have the right to use it (your voice, your composition or a royalty-free track).

The generation engine automatically rejects some requests, and the credit goes back to your balance: copyrighted lyrics, names of real artists, audio that matches existing works and certain sensitive words. Do not try to get around these rejections.

You may not use NUIVI to:

• Reproduce or imitate third-party copyrighted songs, lyrics or recordings, or upload other people’s audio without permission.
• Imitate the voice, name or identity of real artists or people, or present a song as if it were someone else’s.
• Create content that is illegal, incites hatred or violence, sexualizes minors, defames, harasses or violates third-party rights.
• Send spam, defraud payments or the affiliate program, automate access, try to discover or bypass technical limits, or reverse-engineer the service.

In case of abuse or violation of these Terms, we may reject requests, suspend or close the account, at our discretion and without prejudice to other legal measures. Refund requests in these cases follow Hotmart’s rules.

8. Rights over the generated music

The generated song is yours, and you have the right to register it just like any other song. But keep in mind: generating a song does not register it — what you get is the right to register it. You handle the registration yourself, on a registration platform (NUIVI uses Ditto); NUIVI does not register songs for you and does not offer any legal guarantee about specific uses.

NUIVI does not claim ownership of the songs, lyrics and cover art created in your account and charges nothing beyond the subscription for their use. To provide the service, you authorize us to store, process, play in your library and transmit to the infrastructure providers what you upload and what is generated. We do not use your songs to promote NUIVI without your express permission, and NUIVI does not train its own models with your content.

Limits you should know: artificial intelligence systems can produce similar results for similar requests from different people; for that reason, we do not guarantee exclusivity or that a song will not resemble an existing one. Copyright protection for AI-created content still depends on the applicable law and on each case.

You may use the songs in your content, channel or project. Before publishing, check the usage, monetization and publishing rules of the platform where you will post them. NUIVI does not promise monetization, platform approval, reach or income.

9. Availability of files and of the library

• Audio files and cover art: available to play and download for 14 days after generation. Download the MP3 (one track at a time or several in a .zip) to keep what you want. After that period, the file may be removed from our servers.
• Lyrics, titles, descriptions and history: remain listed in your account for as long as it exists.
• Trash: a deleted track stays in the trash for 7 days and can be restored during that period. After that, it is permanently removed.
• Audio uploaded in Cover: kept in private storage only for as long as the generation needs it and deleted within 1 day.
• Preview: while a song is being generated, you can listen to a preview before the final file is ready.

10. Service availability and liability

NUIVI depends on third-party providers (artificial intelligence infrastructure, hosting, authentication and payment). We do our best to keep the service stable, but there may be instability, maintenance, queues and engine rejections. When a creation fails for these reasons, the credit goes back to your balance.

We may change, add or discontinue features, model versions, limits and plans. As there is no minimum term, you can cancel at any time if a change does not make sense for you.

To the extent permitted by law, NUIVI is not liable for lost profits, loss of revenue, removal or demonetization of content on third-party platforms, unavailability of external providers, or the use you make of the songs. Nothing in these Terms limits the rights that consumer protection law guarantees you.

11. Affiliate program

NUIVI has an affiliate program that runs on Hotmart: whoever refers a subscriber receives a 10% recurring commission for as long as the referred person keeps subscribing. Registration, tracking and payment of commissions happen on Hotmart, under its rules.

Anyone promoting NUIVI must do so honestly: without promising monetization, income or platform approval, without spam and without impersonating NUIVI. Links with a referral code store that code in your browser for 30 days. Details are on the affiliate program page.

12. Support

Support is available by e-mail (suporte@roquetrafegopago.com.br) and WhatsApp (+55 19 98268-1810). When writing about a generation, include your account e-mail and what happened — it speeds up the reply.

13. Changes to these Terms

We may update these Terms to reflect changes in the service or in the law. The date of the last update appears at the top of the page. Relevant changes will be announced on the website or by e-mail. If you keep using NUIVI after a change, we understand that you accept the new version; if you do not agree, cancel your subscription through Hotmart.

14. Governing law and jurisdiction

These Terms are governed by the laws of Brazil, including the Consumer Protection Code, the Brazilian Internet Civil Framework (Marco Civil da Internet) and the General Data Protection Law (LGPD). For consumers, the courts of your place of residence apply, as guaranteed by law; consumer protection rules of your country that cannot be waived also apply. If any clause is found invalid, the others remain in force.
